Air Serbia takes its responsibility concerning personal data protection very seriously.

Air SERBIA is a Joint Stock Company established and seated in Belgrade, Republic of Serbia. At Air SERBIA, and our affiliates and branch offices (collectively referred to as "Air SERBIA", "we", "us"), we take our data protection and privacy responsibilities seriously. This statement describes how we collect, process, use, disclose and transfer your personal information as a data controller. It covers instances when you contact us, use our services or interact with our website www.airserbia.com or our mobile app.

If you previously deactivated your account (so you cannot log in) without deleting data, you can send email to dataeraserequest@airserbia.com and personally ask us to delete your remaining data connected to the email you are writing from.

Flight and Booking Information

 

If you use the Air SERBIA Website to make a flight booking or manage a reservation, we will collect and use information about you as necessary to manage the booking. This may include personal information such as your name, date of birth, address, next of kin details, Passenger Name Record number ("PNR number"), gender, passport details, any meal preferences or frequent flyer program membership references such as your username and password (if applicable) together with payment details (such as your credit card number) and contact information (such as phone number and e-mail address) for the lead passenger.

 

Additionally, if you have made your contact information (phone number and/or email address) availabe to us in the moment of purchasing a ticket, such information may be used for the purpose of notifiying you on changes of your travel itinerary.

 

We may also seek to collect from you for the purposes of providing you with enhanced services, such as medical services, special categories of personal data, which are treated with extra care by us. These special categories of data include details relating to your health such as whether you use a wheelchair or require an oxygen tank, certain health behaviors such as whether you are a smoker and your religion. In limited circumstances, such as where we are providing you with chauffeur services, we may additionally collect information about your whereabouts using systems such as GPS.

 

If you or any passenger traveling has special health, dietary or access requirements, which you or they would like us to be aware of, we may collect information about these matters where this is provided.

 

In case you are natural person using our services within the territory of the People’s Republic of China, we will only collect and use sensitive personal information, either with your consent, or when you voluntarily provide us with this information, or where such information is required or permitted to be collected by law or professional standards. Processing of sensitive information is necessary for our services to be provided. Also, in case of processing of personal information of minors under the age of 14, such personal information will be only processed based on the consent of the parents of other guardians of the minors. Where processing is based on your consent, you will have the right to withdraw your consent. The withdrawal of consent shall not affect the validity of the processing activities conducted based on consent before it is withdrawn. This article is applicable in all cases in which sensitive data of natural person within the territory of the People’s Republic of China is being processed for provision of our services.

 

Where you are making a booking on behalf of other traveling passengers, it is your responsibility to represent that passenger in the booking process and explain how we will use their personal information as set out in this Privacy Statement. You must obtain their consent to make the booking and share their details with us as anticipated by this Privacy Statement. We will assume that you have done this. We may be under separate legal obligations to explain to them that we are controlling their personal information, even if it comes to us from you.

Advance Passenger Information

 

On some routes we are required to pass details of the itinerary and booking details in our Passenger Name Record system to border control, customs and law enforcement officers at ports of entry / exit on your itinerary. We will share this information with relevant authorities as required and permitted by local and applicable laws. If you are in, or flying to/from France, please note that in accordance with Article L 237 -7 of French Internal Security Code, air carriers may transmit reservation data collected from their passengers (PNR) to the French national public services and competent authorities for the purposes and under conditions as defined in the Decret N° 2014-1095 dated 26/09/2014.

PRIVACY POLICY

 

This Privacy Policy (the Privacy Policy) explains how your personal data is collected and used in connection with the Elevate Loyalty Programme operated by our airline (the Loyalty Programme).

 

The Privacy Policy contains information about the types of personal data we collect, how we use it, and your rights in relation to the protection of your personal data.

 

The Privacy Policy applies to all personal data processed when you become a member of the Elevate Loyalty Programme, use our website or mobile applications, or contact us in relation to the Elevate Loyalty Programme.

 

1.       THE DATA CONTROLLER

 

Air SERBIA Air Transport Joint Stock Company, Jurija Gagarina 12, Belgrade, Reg. No. 07044275, VAT No. 100001765 (Air Serbia), acts as controller of your personal data within the meaning of the  Personal Data Protection Law of the Republic of Serbia currently in force (the PDPL) or by Regulation (EU) 2016/679 of the European parliament and of the council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (the GDPR), as applicable.

 

2.       TYPES OF PERSONAL DATA PROCESSED

 

Air Serbia may collect and process the following personal data:

 

-      Email address and/or social media login (Gmail, Apple, Facebook)

-      Password

-      Title

-      First name

-      Surname

-      Date of birth

-      Country of residence

-      Language

-      Telephone number

-      Membership number

-      The IP address of the device from which the member accesses their Membership Account.

-      Member's identification document number (only in the event of a change to a membership account that requires identity verification).

 

3.       PURPOSE AND LEGAL BASIS FOR THE PROCESSING OF PERSONAL DATA

 

The main purposes and legal basis for the processing of your personal data are as follows:

 

A.      Managing membership in the Elevate Loyalty Programme

 

We use your personal data to register you for the Elevate Loyalty Programme, maintain your membership, record and manage your earned and redeemed points, manage your status level, and enable you to use reward services and benefits.

 

The legal basis for this processing of personal data is provided by Article 12(2)(2) of the PDPL or Article 6(1)(b) of the GDPR: performance of a contract concluded with the data subject or taking steps at the request of the data subject prior to entering into a contract.

 

If you do not provide the personal data necessary to perform the contract, we will not be able to provide you with the requested services.

 

B.      Communication with members

 

We use your personal data to communicate with you regarding your Loyalty Programme membership, to respond to your enquiries, or to resolve any complaints.

 

The legal basis for this processing of personal data is provided by Article 12(2) of the PDPL or Article 6(1)(b) of the GDPR: performance of a contract concluded with the data subject or taking steps at the request of the data subject prior to entering into a contract.

 

If you do not provide the personal data necessary to perform the contract, we may not be able to provide you with the requested services.

 

C.      Fulfilling the Controller's legal obligations

 

We use your personal data for record-keeping, to prevent abuse and fraud, to resolve disputes, and to fulfil our legal and tax obligations.

 

In the event of suspected misuse, your data may be recorded in internal control systems, which may lead to further checks, or restrictions in the use of our services.

 

The legal basis for this processing of personal data is provided by Article 12(3) of the PDPL and Article 6(1)(c) of the GDPR: the processing is necessary for compliance with the controller's legal obligations.

 

If you do not provide the personal data necessary to perform the contract, we may not be able to provide you with the requested services.

 

D.      Advertising

 

If you become a member of the Elevate Loyalty Programme and consent to receiving advertising messages, we may use your personal data to inform you about offers, benefits and news related to the Elevate Loyalty Programme and the services of the organiser of the Elevate Loyalty Programme.

 

To provide more relevant content, advertising messages may be based on profiling, i.e. the automated processing of data on activities within the Elevate Loyalty Programme (such as travel history, service usage and preferences), in order to tailor offers to the member's interests. Such profiling does not produce any legal consequences for you, nor does it significantly affect your position.

 

The legal basis for this processing of personal data is provided by Article 12(1) of the PDPL and Article 6(1)(a) of the GDPR: The data subject has consented to the processing of their personal data for one or more specific purposes.

 

E.       Statistical surveys

 

We may analyse general trends in the use of the Elevate Air Serbia Loyalty Programme, website, mobile applications and social media, and the behaviour and preferences of Loyalty Programme members.

 

The results of these analyses are used to improve the Elevate Loyalty Programme, develop services and offers, improve customer support and optimise the content and design of digital channels.

 

For this purpose, we use aggregated or pseudonymised data, which do not allow for the direct identification of an individual person.

 

The legal basis for this processing of personal data is provided by Article 12(6) of the PDPL or Article 6(1)(f) of the GDPR: the processing is necessary for the purposes of the legitimate interests pursued by the controller or by a third party, except where such interests are overridden by the interests or fundamental rights and freedoms of the data subject which require the protection of personal data.

 

4.       PERSONAL DATA RECIPIENTS

 

In the course of its business, Air Serbia may engage data processors and other service providers who may process your personal data on behalf of and for Air Serbia, exclusively in accordance with its instructions and with the application of appropriate data protection measures.

 

Furthermore, in accordance with applicable air transport regulations, Air Serbia may be required to disclose your personal data to government authorities, regulatory bodies or other competent institutions.

 

Your personal data may be disclosed to the following categories of processors, to the extent necessary:

-      operators of the Elevate Loyalty Programme who manage and maintain the software solution for the Elevate Loyalty Programme on behalf of Air Serbia;

-      payment processing service providers;

-      IT and technical support;

-      accounting and auditing service providers;

-      customer support (call centre);

-      legal advisers and other professional service providers;

-      partners participating in the Elevate Loyalty Programme.

 

We will ensure by contract or other legally binding instruments that all processors process your personal data in accordance with the PDPL or GDPR, and that they apply appropriate measures to protect your personal data.

 

5.       TRANSFER OF PERSONAL DATA

 

In certain cases, your personal data may be transferred to Air Serbia's business partners who process personal data on behalf of and for Air Serbia, and who may be located outside the territory of the Republic of Serbia, in countries that may not provide the same level of personal data protection as the Republic of Serbia. However, the agreements entered into with these entities ensure that your personal data is handled with special security measures, in accordance with the regulations in force in the Republic of Serbia.

 

The transfer of such personal data will be carried out in accordance with the PDPL and the GDPR. If you require any further information regarding the measures for the protection of the personal data being transferred, you may submit a request via e-mail to dataerserequest@airserbia.com.

 

6.       PERSONAL DATA RETENTION PERIOD

 

Personal data is retained for as long as is necessary to fulfil the purpose for which it was collected, after which it is deleted or anonymised, except in cases where a longer retention period is required by applicable laws.

 

The data we collect as part of the Elevate Loyalty Programme will be stored for as long as your membership account is active, i.e. while you are participating in the Elevate Loyalty Programme, and for up to five years after your membership expires or your account is deactivated, unless a longer period is required by law. This period allows us to provide the necessary information in the event of any claims, disputes or other legal requirements that may arise from your participation in the programme.

 

7.       YOUR RIGHTS

 

Subject to the conditions prescribed by applicable laws, you have the following rights at all times with regard to the processing of your personal data:

 

a.       Right of access to personal data

 

You can ask Air Serbia to confirm whether or not it processes your personal data. If the answer is positive, you can request a copy of the personal data that Air Serbia processes.

 

b.       Right to rectification of personal data

 

You can ask Air Serbia to correct inaccurate personal data and supplement any incomplete personal data it processes.

 

c.       Right to erasure of personal data

 

You may ask Air Serbia to erase your personal data in the following cases: (i) if the personal data are no longer necessary for the purpose for which they were collected, (ii) if you have withdrawn the consent on which the processing was based, and there is no other legal ground for the processing, (iii) if you have objected to the processing of your personal data in accordance with applicable laws, (iv) if the personal data has been processed unlawfully, (v) if the personal data must be erased in order to fulfil the controller's legal obligations.

 

The right to erasure of personal data may be restricted if the processing of personal data is necessary for: (i) the exercise of freedom of expression and information, (ii) compliance with a legal obligation of the controller which requires the processing or performance of tasks carried out in the public interest or the exercise of official authority of the controller, (iii) the establishment, exercise or defence of legal rights.

 

d.       Right to restrict the processing of personal data

 

You have the right to request that the processing of your personal data be restricted if one of the following conditions is met: (i) if you dispute the accuracy of the personal data, for a period that allows the controller to verify its accuracy, (ii) if the processing is unlawful and you object to the erasure of the personal data and request the restriction of its use instead, (iii) if the controller no longer needs the personal data for the purposes of processing but you have requested the data for the establishment, exercise or defence of a legal claim, (iv) if you have objected to the processing of your personal data and a balancing of interests is underway to determine whether the controller's legitimate grounds for processing override your interests.

 

If the processing is restricted, the personal data may be further processed only on the basis of your consent, except for storage, or for the purpose of establishing, exercising or defending a legal claim, or for the protection of the rights of other natural or legal persons, or for reasons of significant public interest.

 

e.       Right to data portability

 

You have the right to receive your personal data which you have previously provided to the controller from him in a structured, commonly used and machine-readable format, and you have the right to transmit this data to another controller without hindrance from Air Serbia, if the following conditions are both met: (i) if the processing is based on your consent or is necessary for the performance of a contract concluded with you or for taking steps, at your request, prior to entering into a contract, and (ii) the processing is carried out by automated means.

 

You also have the right to have your personal data transferred directly to another controller by Air Serbia, where technically feasible.

 

f.        Right to object

 

You have the right to object to the processing of your personal data where we are relying on a legitimate interest, or where we are processing your personal data for direct advertising (including any related profiling, where applicable).

 

g.        Right to withdraw consent

 

If the processing of your personal data is based on consent, you have the right to withdraw your consent at any time. Withdrawing your consent does not affect the lawfulness of processing based on consent before its withdrawal.

 

You can withdraw your consent by using the appropriate option in an advertising message you have received, or via the relevant options in your membership account settings.

 

h.       Right to complain to the supervisory authority

 

Should you believe that the processing of your personal data is being carried out in breach of applicable regulations, you have the right to lodge a complaint with the competent supervisory authority.

 

You may contact the Commissioner for Public Information and personal data Protection in accordance with the PDPL, or the supervisory authority in the EU member state where you reside, work, or where an alleged breach has occurred, if the GDPR applies to the processing.

 

8.       SAFETY MEASURES

 

We implement administrative, technical, organisational and other measures to ensure an appropriate level of security for the personal data we process, and the regular testing, assessment and evaluation of the effectiveness of the measures applied. When assessing whether a particular measure is sufficient and what level of security is appropriate, we take into account the nature of the personal data we process, the nature of the processing operations we carry out, the risks you are exposed to as a result of our processing activities, the costs of implementing security measures, and other relevant circumstances of the specific case.

 

Some of the measures we implement include the application of appropriate procedures and policies, access control, information classification and handling, protection of integrity and confidentiality, data backup, firewalls, data encryption and other appropriate measures.

 

We provide our employees with continuous training to ensure they have the appropriate knowledge and understanding of the importance and confidentiality of the security of your personal data.

We reserve the right to amend this Privacy Policy from time to time. Any changes will be posted on our website. We recommend that you check it regularly, particularly when booking flights with Air Serbia.

Etihad Guest Frequent Flyer Program

 

Our Frequent Flyer program is managed within our Partner Etihad Airways PJSC from Abu Dhabi in United Arab Emirates with its subsidiaries. If you join our frequent flyer program, Etihad Guest, you will be asked to register your personal details with Etihad Guest. This will allow Etihad Guest to manage your account and provide you with rewards and benefits. This may include information such as your name, date of birth, address, email, telephone number, next of kin, your photograph, passport details, your credit card details including its expiry date, your Etihad Guest Number, PNR number, flight ticket number, professional details such as your profession, title, role, including professional licensing numbers. In exceptional circumstances Etihad Guest, may have access to certain personal data, including Special Categories of personal data (as defined in the General Data Protection Regulation) obtained during the course of your flight, as set out in this policy.

 

When you join Etihad Guest, you will be asked to confirm that you agree to share data between Air SERBIA and Etihad Guest to receive these benefits. Any information shared with Etihad Guest is held subject to Etihad Guest's separate privacy policy and terms and conditions, which you can find here.

Customer Support and online services

 

If you contact us with a query or comment about any of our services, or would like us to keep you informed about latest news and developments at Air SERBIA, we will need to collect information about you (including your contact details) to help us respond to your query or request. We may do this when you call our customer support centre, or interact with us through our online support tools. This information may include your name, date of birth, address, email, telephone number, next of kin, your photograph, passport details, your credit card details including its expiry date, your Etihad Guest Number, PNR number, flight ticket number, professional details such as your profession, title, role, including professional licensing numbers. We may also need seek to collect from you Special Categories of Data, for the purposes of properly understanding your query or request, which are treated with extra care by us. These Special Categories of Data may include details relating to your health such as whether you use a wheelchair or require an oxygen tank, certain health behaviours such as whether you are a smoker, your race and ethnicity, your religion

 

We may also keep a record of any communications we have with you (including a recording of any calls you make). We do this in compliance with applicable laws to help monitor and improve the quality of our customer support services, to make and defend legal claims, and to comply with legal obligations to which we are subject.   • Partner airlines where you are traveling on a booking which involves a codeshare;
  • Frequent flyer and other reward and partner programs where required to enable you to earn or utilize frequent flyer miles by virtue of your membership of Etihad Guest;

  • Other third parties who help manage our business and deliver services. For example, these may include IT service providers who help manage our IT and back office systems, or third party booking agents;

Transferring personal information globally

 

We operate our business on a global basis. The countries to which we commonly disclose your personal information include the Republic of Serbia, and the countries where you are flying to and from. Some of these countries, for example, the UAE and the USA, have laws which do not offer, in the opinion of the European Commission or other supervisory authorities, an adequate level of data protection.

 

In case you are natural person using our services within the territory of the People’s Republic of China, in order to meet requirements of applicable regulations, we will need your consent for transferring your personal information globally.

 

We will always strive to adopt the highest standards of privacy protection, wherever your personal information is located and adopt appropriate measures (consistent with locally applicable laws) to secure an adequate level of privacy protection. We will take appropriate steps to ensure that transfers of personal information are in accordance with applicable laws and carefully managed to protect your privacy rights and interests. Transfers will be limited to countries which are recognized as providing an adequate level of legal protection or where we can be satisfied that alternative arrangements are in place to protect your privacy rights.
